Civil Appeal System Research

Appellate procedure is an important procedure of civil proceeding. If one suit has been judged in appellate jurisdiction, it will have the effect of final verdict. The impartiality of appellate procedure is of importance to the impartiality of procedure. Good study and design of appellate procedure is of most importance to the impartiality of justice. This article will use the advanced experience of other countries for reference in the designs of appellate procedure through investigation of the legislation citation in civil appellate procedure, and by comparison, and self-questioning the situation of our country civil appellate procedure, put forward a tentative plan which will help to reform and perfect our country's appellate procedure. Thus, we hope to establish a relatively reasonable civil appellate procedure. This article contains two parts, and is about 34000 words.Part I: the comparison of the civil appellate procedure of all country. In this part, firstly, the author in investigates the historical evolution of appellate procedure, and the origin and development of China's ancient and England's civil appellate procedure, secondly, the five representing country's civil appellate in Anglo-American law system and continental law system, simultaneously, the author makes investigation of the civil appellate procedure of China's Taiwan and World Trade Qrganization.
