Using comparison and insuctive methods,this dissertation discusses systematically the problem of status in criminal law. I hope it can give some help to our Chinese criminal legislation and criminal justice .The article includes introduction body language and the endThe introduction is about the significance of Chinese criminal law.This text includes three parts. The first part is the status of Chinese criminal lawin a theoretical perspective, and is divided into two chapters. The first chapter is a general theory. First on the notion ,history and characteristics of the status it makes a summary analysis; then the concept of the status and its general feature.in Chinese criminal law.It includes not only the status of the law, but also judicial status, not only natural status, but also units status; And it has five characteristics :factual character, the main sexual status, the nature of sexual tatus, legal status and the first time. My second chapter is about the classification and the role of status, it can be divided into natural status and statutory status, , convicing and sentencing status,positive and negative status and the fixed and unfixed status.,The role of status can be divided into : using conventional production, embodying the principle of equality of criminal law, the principle of balanced expression crimes, conviction and sentencing role. The second part is about the status in our legislative perspective.. Some theories are analysed on the basis of the status in the perspective of a crime committed; then it gives some advise on the legislation and the defination of the status.The third part is the status in criminal justice perspective ..
