A Study On Article 49 Of Law Of The People's Republic Of China On The Protection Of Consumer Rights And Interests

The protection of consumer rights and interests is becoming more and more important with the social and economic development. While in China, operators' deceiving behaviors in economic activities have greatly hurt consumers' rights and interests and largely influenced the social and economic order. In Article 49 of Law of the People's Republic of China on the Protection of Consumer Rights and Interests, for the first time legislature sets the responsibility for punitive compensation in order to punish and hold back this kind of activity. It regulates: if operators provide deceitful products or services, the sum of compensation should be increased according to consumer's request for his/her loss. The money increased is one time that of the original price of the product or the service. Nevertheless, the justice of Article 49 has been disputed. Meanwhile, in the applying process, there are many questions which have been still discussed by people in judicial practice, for article's interrelated concept of law is not quite clear.Chapter One proves the justice of the Article 49 of Law of the People's Republic of China on the Protection of Consumer Rights and Interests.
