Patent Rights Abuse And Its Control

We should value the restriction to patent rights when we are enhancing protection of the patent rights to keep patent rights from abusing. There have already the mature ways about it abroad and they obtain the good result. We can't despise the problem of patent rights abuse both from perfecting patent rights and from promoting the development of economy.This text studies patent rights abusing and its control from three aspects.(1) Analyze the intention, the constituent important documents and categories of patent rights abuse.(2) The jurisprudence significance, principles and characteristics to control patent rights abuse. Our aim is to research basic reason why we control patent rights abuse.(3) The way to control patent rights abuse from the Patent Law and Antimonopoly LawThe author wants to find a way to control patent rights abuse from the Patent Law and Antimonopoly Law. The departments concerned must formulate more detailed and more concrete guidebook or regulation. Ultimately we can perfect our country patent system, provide the good environment for the development of the market economy.
