Studies On Several Issues In The Trend Of Maritime Arbitration System

Maritime arbitration has a long history. With the development of international trade and global economy,maritime arbitration system has taken on the new trend since the twentieth century. However, in the world, the industry of Chinese maritime arbitration obviously lags far behind, and the Chinese maritime arbitration system is far from satisfaction. Summarizing the trend of maritime arbitration system is of great help to the development of Chinese maritime arbitration.Viewed from the point of theory, practice, legislation and cases, this thesis makes a comprehensive study on several issues in the trend of the maritime arbitration system, and raises some suggest on the development and betterment of Chinese maritime arbitration system. This thesis consists of forward, 4 chapters and epilogue, more than 40000 Chinese characters."Forward"briefly introduces the cause and the purpose of writing.Chapter 1"The Introduction of Maritime Arbitration". It introduces the concept and the characteristics of maritime arbitration, and the history of maritime arbitration. It also introduces the development and achievement of the industry of Chinese maritime arbitration.Chapter 2"The Legislation and Its Trend of Maritime Arbitration". It introduces the international conventions, British maritime arbitration system and the legislation in Chinese in the field of maritime arbitration. On the base of the introduction above, it summarizes the trend of legislation, namely the uniform of the maritime arbitration system.Chapter 3"The Development and Its Trend of Maritime Arbitration". It discusses the development of maritime arbitration from three aspects, such as maritime arbitration agreement, arbitration procedure and the court's function of assistance and supervision, and summarizes the developing trend.Chapter 4"The Development and Betterment of the Chinese Maritime Arbitration System". It analyzes the main reasons which block the development of Chinese maritime arbitration, and raises some suggest on the development and betterment of Chinese maritime arbitration system."Epilogue"hopes the whole society to struggle for the development of Chinese maritime arbitration system.
