Sexual harassment is common in workplaces across the world.It is overwhelmingly directed at women.With several cases reported from 2001,sexual harassment at work is becoming an attention-getting problem in our country.While there is no special law on it for the present time.What is the legal definition of sexual harassment in workplace? How can we recognize its essence of law?How do other countries combat it legally?How to establish suitable legal system of sexual harassment in workplace in our country?This article attempts to find out the answers to these important problems.The thesis is divided into four parts.Firstly,the thesis introduces the situations of sexual harassment in workplace at home and abroad through citing cases and datas,it appears to be necessary to combat it.Secondly,the thesis focuses on the heavy costs that the sexual harassment in workplace imposes on its victims,their employers and the society.Thirdly,the thesis introduces the legal systems of sexual harassment in workplace outbroad,including the source of its definition,relevant legislations of other countries and legal documents of international organizations and regional organizations,its legal definition,and its character.Then this part confirms that workplace sexual harassment is a facet of workplace discrimination.This part also emphasizes the legal system of America to provide reference.The fourth part contains establishment our country's sexual harassment legal systems via the category of the Chinese labour law.The author's opinion is to amend present labour law and group contract rule,and put it into the new legislation of labour contract law,adopt better evidence system,set employer liability,etc.All above aim at finding out a feasible legal system of sexual harassment at workplace and protecting the legal rights of employee.
