Research On The Establisment Of Chinese Public Interests Litigation

Public interests litigation is a kind of lawsuit form established for the maintenance of national and public interests. It grew out of the severe situation of public problems which comes from the rapid development of economy and technology and the enlargment of socialization since the Industrial Revolution. Also ,it is a kind of new litigation system founded on the law system for adapting to social and economical transformation. In the period of developing the socialist market economy in our country, it is necessary to establish a proper public interests litigation system by taking the foreign experience for reference.On the one hand ,it can comply with the tendency of development of legislation in the world and fulfill our law system.On the other hand ,it is one of the effective methods to solve the enlarging public problems. And what's more, it is also necessary for a legalized and democracy nation.The purpose of this article is to discuss some theoretical and pratical problems of establishing a public interests litigation system in our country and hoping to give some supports and helpful reference to it. From this point of view, the essay first introduces the concept and the overseas development of public interests litigation. And then , analyses the necessity and the feasibility of this law system to make clear of the basis of it. In the last two parts of this article, the contents touchs several sides of the establishment of the public interests litigation, including the right way for found it and the arrangements of its specific rules. All of these were done with the methods of Marxism.
