This article mainly takes how to correctly solve problems of the real estate dual sales as a center, analyzes to the legal question which involves in the practice of legal matter. In the content arrangement, this article mainly divides into two major parts. The first part mainly deal with the problem of dual sales why exist. This is the key to deal with the problem of the real estate of dual sales. Because only confirm the legality and legitimacy of the dual sales, can we offer the legal foundation to correctly deal with the problem of the dual sales, and distinguish the legal liability between parties. The second part is mainly about the problem of how to relief and prevention. By compared with more relevant foreign legislations and practice experiences in dealing with, this text thinks, when we deal with the problem of the dual sales, our country legislation should adopt methods of statutory relief and agreed relief, risk prevention and risk remedial, combined with the seller and buyer interest, make full use of the adjustment function of law of obligation and real laws. Only in this way, should the dual sales problems be effective relief and prevention.
