Local Factor Influence To The Promotion Of The Rule Of Law In Chinese Rule Of Law's Construction

China is at the beginning of the new century. With the completion of the market economy and the promotion of the political system reform, construction of the rule of law has become the issue that government and public concerned mostly. Especially after the entrance of WTO, our country began to face the challenge we've never met. In order to attend the world economy club and be the ingredient of the global market, China has to obey the game regulation. We are required to establish the rule of law that is more suitable to the economy development, more transparent and more popular to public.It is clear that the discussion about the construction of rule of law was not a new topic. It was raised up for a long time and experienced a period of wrong road once. From seeking the quantity and coverage of the law blindly to noticing the quality of legalization, from only transferring the western theory and sprit to China at the beginning of the reform to valuing the function of the local factor, the academic discussion of the rule of law is developing at a more available direction.The main problem of the current discussion by the Chinese experts is that at the mean time of we researching the more advanced western theory we are easily to ignore the Chinese actuality. Although the combination of the foreign advanced theory with the Chinese practice is not a new task, we are still lack of efficient method to position and utilize the local factor. There is a tendency to adapt the Chinese actuality to the advanced theory forcedly. In the author's point of view, when we are promoting the process of rule of law the local factor should be concerned abundantly. The main aspects are the weakness of Chinese economy, unique traditional culture of rule of law, long term of the political system reform and the defect of the civil society. The factors above make Chinese rule of law construction special.Combining with the 4 factors above and searching the method of construction rule of law that is suitable to China are the problems that are demanded to solve. But the procedure of considering and researching must be long and rough. It is also difficult to the author find a definite and effective response. The only thing we can say is the direction of our effort is stable. Consider the current Chinese actuality sufficiently, realize the update meaning of our unique local factor and complete the transformation and mergence of the local factor with the current rule of law, with the demand of the current theory and economy.
