Construction And Consummation Of Foreign Investment Law

In the international investment area, Foreign Investment Law is the name of category of the laws and rules which are drawn up by capital importing countries to adjust the private direct foreign investment. It is an important constitutive part of international investment law. In modern international ecnomic society,both developed countries and developing countries, join the queue of capital exporting countries, introduce and utilize foreign capital after they have recognized the more and more substantial function of foreign capitals. Furthermore, various forms of laws and rules have been made to adjust the foreign investment relationship effectively.After the first "Law of the People's Republic of China on Chinese-Foreign Equity Joint Ventures" enacted in 1979, our country has drawn up many laws on foreign investment, forming a foreign investment law system with the foreign investment enterprise law as the center. These laws meet the requirement of ecnomic reform and opening to the outer world, playing important roles in utilizing foreign capitals.But as the development of our country' s market economy and the wider openning to the outside, the current law-making modes shows some disharmony, and there are some rules in our foreign investment laws which do not agree with WTO' s regulations. All of these problems are crucial to be studied and resovled as soon as possible.Starting from basic theories, this paper systematically discusses formation, development, function and system of foreign investment law of our country.Then.it illustrates the development of foreign capital law-making in developed countries and developing countries.
