Studies On Abolishing Death Penalty In Economic Crimes

It draws public attention to keep or abolish death penalty in economic crimes. Different people have different opinions about it. I think that the death penalty in economic crimes should be abolished. In this article, I am going to discuss my views about abolishing death penalty in economic crimes.Imposing death penalty on economic crimes is not reasonable. The economic crimes are property, wisdom crimes. They are also changeable and complicated crimes. So, not imposing death penalty on economic crimes depends on the characteristics of economic crimes. Imposing death penalty on economic crimes violates one of the basic principles of criminal law —the degree of punishment being commensurate with the crime committed and the criminal responsibility to be borne by the offender. The modest of criminal law requires that the criminal law should interfere the social life as little as possible. Imposing light penalty on crimes should also be its requirement. So the death penalty should not be imposing on economic crimes. In addition, humanism asks that the government should be tolerant when imposing penalty on crimes, therefore imposing death penalty on economic crimes violates the humanism. China is a big socialist country, but china is an only country among those several countries keeping the death penalty in economic crimes. This disgraces our country. Applying death penalty to economic crimes doesn't conform to the regulations of International conventions on civil and political rights. It stipulates that sentence of death may be imposed only for the most serious crimes in countries which have not abolished the death penalty. However the economic crimes do not belong to serious crimes. Finally, imposing the death penalty on the economic crimes is disadvantageous to international and regional criminal judicial cooperation. With the international crimes increasing, we must cooperate with other countries. But the death penalty makes us being in embarrassed situation.
