On The Perfection Of China's Environmental Tort Civil Liability System

Environmental tort, as a special tort, is specified in every country's civil law. However a lot of differences exist between it and common civil tort. For example, it has its own characteristics in tort subject, tort object, tort behavior, tort extent and scope. Civil liability system of environmental tort is one special system developed based on the characteristics of environmental tort. In China, currently there is no profound research about the civil liability system of environmental tort, and relevant legislation is not complete, even the regulation about this in civil law code is not satisfactory. In view of this problem, integrated with the author's experiences in teaching environmental tort, this thesis will carry out a profound and systematic study and propose some suggestions regarding to relevant legislation and system construction, expecting to push forwards further development and perfection of China's environmental tort civil liability system.
