On Indirect Infringement In Patent Law

The patent indirect infringement is to redeem the disadvantage of traditional patent infringement, so that carry out the value of patent system. China's law is poor in this aspect, this paper including four parts, is to illustrate the vision of building up patent indirect infringement system.This paper is composed of four parts. The first part focuses on the origin of patent indirect infringement first, then presents the definition and nature of patent indirect infringement. The second part reviews the system of patent indirect infringement in America, Japan and EU. The third part analyses the current situation of patent indirect infringement in China, and necessity of the introduction of patent indirect infringement into China's legal system. The fourth part puts forward suggestions of framing patent indirect infringement system that contributory infringement acts as the majority and inducing infringement acts as the minority.
