Legal Matters Concerning Disposal Of Critical Group Incident

Therese years, it has become an outstanding issue, which affects the social stability and development in the new age as there are more and more critical group incident resulting from all kinds of social disputes. In case such critical group incident cannot be solved and disposed of effectively, it could be evolved into significant political issue, affecting the social and political stability and divert the reformation and development. This thesis, from perspectives of concept, characteristics, nature and reason, intends to define critical group incident and reveal the status of existing disposal of critical group incident of China objective and have preliminary discussion on the matters relating to our problems when disposing of critical group incident, including disordered legislation, tendency of rule of men and problem of police department relating to disposal of critical group incident. This thesis introduced the overseas theory, practice and experience with relation to critical group incident and did a comparison between China and other countries on legal systems governing and administrating assembling, parade and demonstration. Finally, the thesis presents it own thoughts concerning improvement of disposal system on critical group incident, defines the principles on disposal of the critical group incidents and further proposes to set up limitation system on disposal power and improve the remedy system in the administrative law. In conclusion, we have to make scientific design at strategic level and from long development perspective, and the long term effective solution is legal system if we are going to solve and dispose of critical group incident basically and achieve social harmony.
