The thesis has discussed how to establish a reasonable disciplined compesation system in product responsibility in order to deal with present conditions, overflowing of counterfeit goods and seriousness of infringing upon product rights that has happened in China's market. Firstly the thesis, from theoretical basis and real requirement, has expounded the regularity and necessity of drawing into the disciplined compesation system in product responsibility. Thus, summarize general trend which is confined on disciplined compesation by most countries. Through introducing adaptable condition of the system in nations' product responsibility in Britain and America, as well as in continent; and make analyses on the reasons of the trend. Based on the analyses there are two questions: whether the foundation of view supported by reformists that disciplined compesation should be confined exists; whether the action toward its confinement in judicial procedure is conformed to purpose and function.
