Analysis On The Legal Issues Of Employment Of Insurance Funds

After the opening-up, with the penetratingly development of Chinese financial reform, the scope of insurance in China has appeared to mount up dramatically, especially during these years, insurance industry in China comes into form primarily. However, with the development, companies seem to get into a strange recurrence: the larger the scale is, the higher the risk goes. The fundamental cause lies in the employment of Insurance funds. The employment of Insurance funds is now paid much attention to by our insurance industry and intellectuals.It is an important thesis, which is must to faced, to enhancing the employment of Insurance funds for insurance industry in our country. Based on the principles of comparison, demonstration and from practical view, The author firstly analyses what is the employment of insurance funds and its meaning. Then, legal systems of the insurance funds employment in some western countries and new developing countries are compared. Based on the reality, the author explores the existing problems and puts forward their solutions. AT last, under the condition of financial freedom and globalization of financial, the problems, which supervising the employment of insurance fund faces, are studied, and the countermeasures are proposed.The paper is divided into five parts. The employment of insurance funds, includes its concept, composing, signification, is discussed theoretically in the first part. The second part is to comparatively study the legal systems of the employment of insurance fund in countries, such as U.S.A, U.K, Japan, Germany, South Korea, Singapore and the region of Taiwan. The third part analyses the existing problems in Chinese insurance industry and put forward their solution. In the forth part, combining the reality of capital market in our country, four problems, which should be paid more attention to, are analyzed thoroughly.。The last part especially points out the defects in the legal systems of the supervision of the insurance fund and puts forward the solution under the condition of financial freedom, globalization of financial.
