Shipping is one ever-increasing major oil pollution source of marine environment, especially with large amount of crude oil transshipped at sea with VLCC nowadays. The oil pollution disasters taking place globally in the 20th Century urged the maritime states and relevant international Organizations to make their laws for the oil pollution compensation regime.As a maritime power in the world, China has always been active in protecting the marine environment as well as the rights and interests of those suffered in oil pollution accidents. However, an overall oil pollution damage compensation regime has not been established in China so far.The purpose of this dissertation is to make a comprehensive study of the compensation for oil pollution damage arising from collision of ships at sea. After a comparative analysis of some relevant international conventions and national laws, this dissertation focuses on the regulations and legal practice of our country concerning compensation for oil pollution damage from ships and suggestions on the establishment of our oil pollution damage compensation system. The details are as follows:Chapter One gives a brief introduction of the oil pollution damage compensation system, including the definition, nature and characteristics of oil pollution damage from ships and the parties related to oil pollution damage compensation.Chapter Two introduces the rule of liability for oil pollution damage from ships. The rule of liability is tortuous in nature, and is one of strict liability within its sphere of operation.A collision of ships at sea may cause oil pollution damage and lead to two kinds of tortuous liabilities.
