The crime of guilty in defender's or legal representative's destroying evidence or forging evidence or impairing to bear witness is a new crime of the criminal law. This article includes 7 parts, it explained almost basic problem of this crime.The first part is a brief introduction of the conception of the crime, the foundation and the necessity.In the second part, it expounds the scope of the subject comprehensively and detailedly, especially has an analysis and presentation for lawyers involved in the stages of the criminal. I explain the object of the crime from three kinds of behaviorIn the third part, and define the behavior of threatening or seducing witness to change testimony which contrary to the facts.The fourth part is about the essence and the root of system on this crime. On the one hand, the criminal need lawyers, but on the other hand the status of China's defense counsel is very low and plays a little role at present.Part V is about a reasonable analysis of this crime from two perspectives; on the one hand, China established its lawyers perjury rationality, on the other hand, there are many of the issues to be perfected.In the part VI, I think it is necessary to determinate the criminal responsibility exemption principle. If we established a societal criminal lawyers immunity in China, and come up with better ideas to resolve those problems, the lawyers can play a proper role in criminal defense.
