Status crime is an important category in the criminal law study. The research on status crime divides into two parts generally in the continental legal system. One part is about the discussion on the question of criminal subject, which is researched as the question of special criminal subject in crime constitutive essentials in our country. The other part is the joint crime question about the status crimes, which is researched as one question in the joint crime. Obviously, this research has not set up the independent theoretical character but is embraced the other theories.Beginning with the concept of status in criminal law as the logical premise, the article reconfirms the meaning of status crimes and opens a stretch of foothold in the criminal law theory to establish the independent character to the theory of status crimes. This theory provides the basis to the criminal legislation and the criminal judicature, and it should solve the problem of status crime in the judicial practice.The article divides into three parts: Discrimination of the related concept of status crimes; Research on the types of status crimes; Discrimination of the mixed status joint crimes and the criminal liability about them.The first chapter proposes the definition of status and the status crime. The author points out that status crime is a kind of crime whose determination of guilty and weight of the penalty is affected by status, which produces the premise to researching the question of status crimes.
