The Research On Appropriate Adult Participates In Interrogate System

Juvenile crime and delinquency has been a serious problem in today's world. How to reduce juvenile crime and how to rectify the related teenagers does not only matter much to the teenagers themselves, but also has much to do with the development of our country and our nation. The whole legal literati had done a lot of research to the characteristics, causes, way and model of rectifying for Juvenile delinquency and achieved great success in these criminal and crime aspect. But they had not pay enough attention to the treatment to which when the juvenile going through litigation. Should we set up a special litigation to juvenile that will be different from normal procedures? Should we take special care for juvenile during the litigation? How to set up the special litigation to juvenile? So we are lack of a systematical research about setting up a special litigation procedure for juvenile crime. Although this is a subject with extend scope, this article try to make some contribution to it through the appropriate adult participates in interrogate system.This article has four chapters. The first article is summarize of the appropriate adult participates in interrogate system. Introduce the conception and the genesis of the appropriate adult participates in interrogate system and introduce the modes and the functions in Anglo-American country.The second chapter analyses the nomological basics of the appropriate adult participates in interrogate system with three aspects. The first aspect is the relation between the appropriate adult participates in interrogate system and the characteristic of body and mind of the juvenile. The second is the relation between the appropriate adult participates in interrogate system and bidirectional protection. The third is the relation between the appropriate adult participates in interrogate system and the development of Due procedure.The third chapter introduce the trial of the appropriate adult participates in interrogate system in China. Abstracting the achievement and the problems through the analyses of trial in Panlong county of Yunnan Province and Pudong New Area of Shanghai.The last chapter is the advice of the creation of the appropriate adult participates in interrogate system in China. It consists of the range of the application, the phase of appropriate adult entering the interrogate, the scope of appropriate adult, the right and the duty of appropriate adult and the procedure of the system.
