On The Legal Attribute Of Human Capital

Human Capital Theory originates from economics. It is the summation of knowledge, physical force and skills on human bodies. It is virtually the labor ability of mankind. Under traditional economic conditions, manpower exhibits as physical force and experience. With advent of the economy based on knowledge, the manpower more exhibits as expertise and skill of people. As the impact on the law, especially on the company capital legal system, becoming heavier and heavier, it is urgent to bring it from economics to law. And the most important task is to analyze and define the legal conception and legal attribute of human capital. From the point of view of economics, this thesis probes into the legal conception of human capital, analyses the differences between human capital and some correspondent conceptions, the legal character ,and the legal attribute of human capital in an attempt to pave the way of application of the Human Capital Theory in the law.
