Affected by the traditional-minded development of economy-with agriculture supples primitive accumulation to industry and constituted in the era of planned economy, China's existing land acquisition system has played positive roles to meet government's need of nonagricultural building land , reduce the construction cost and establish the system of state-owned urban land. Because of the imperpect acquisition system, incomplete supervision and coercive power, local governments have played main roles and been the major promoter of land acquisition. However, the interests of the farmers are seriously violated, triggering off lots of social troubles, which have been major obstacles to the development of rural productivity and social stability.According to the general land use planning, 1,233,333 ha. of arable-land were needed from 2001 to 2010 in total, in which 90 percent is collective land. Undoubtedly, large-scale of collective land acquisition will cause large number of land-loss farmers. Under the condition of providing enough building land, how to define goverment behaivor mitigate contradictions between government and land-loss farmers, guarantee the interests of farmers and protect and utilize land resources completely become an important topic of effectively solving the issues of"agriculture, rural areas and farmers", promoting integrative development between urban and rural area and constructing a harmonious society. Based on it, this paper justly choose the subject and study it.The paper begins with an elaboration of basic theories of government behavior. Based on the analysis of the current situation of land acquisition system and the behavior of the participants, the paper points out the main reasons of local government's improper behaviors, which includes the chasing for economic benefits, ineffectiveness of supervisory mechanism and monopolization of government behavior. Then, the paper does economic analysis of local government's behavior in the process of land acquisition. Next, based on summarized the foreign advanced experiences, the paper puts forward the function of local government and presents the index system of evaluating local government. Finally, some countermeasures are listed for guiding the local officers.The full paper includes seven chapters altogether, details as follows: Chapter1, Introduction. The background, significance and objective of subject-selecting are pointed out, the research fields and methods are put forward, and the system of foreign land expropriation are introduced and appraised.Chapter2, Related theories of government behavior in the land acquisition process. It includes Theory of Land Property Right, Public Choice Theory, Transaction Cost Theory, Institutional Change Theory, the Theory of Government Malfunction, and so on.Chapter3, Problems of local government in land acquisition. It includes improper use of land acquisition right, violation of farmer's interests, excessive free discretion power of administrative organizations and power abuse, low transparent degree of land acquisition, less compensation casused by non-markert-oriented behavior of government, corruption in process of enforcing land acquisition policies, and inconsistency of rules, laws and policies.Chapter4, Discussion about local governments'behavior. The paper analysed reasons to governments'behavior, which include monopoly position, game behavior among all participants, economic benefit and political interests, ineffectiveness of supervisory mechanism and improper government behavior.Chapter5, Experiences of local government in land acquisition. The paper analyses how the western countries do in land acquisition and draws lessons from their functions of local government. Some experiences are given: (1) perfecting the government behavior by legislation, (2)classifying the scope of land acquisition, (3)normalizing the procedure of land acquisition, (4)establishing arbitration organization.Chapter6, Function definition of local government in land acquisition. The author discusses local government working position and performance evaluation. The former includes establishing idea of land acquisition rights, choosing proper model of land acquisition, transforming government functions and realising the function separation between owner and administrator, appropriately arranging land-loss farmers, keeping freely information flow, ect. On the other hand, AHP method is used to evaluate the performance of local government.Chapter7, Measures to perfect functions of local government. It includes constructing rules and laws, perfecting property rights system of rural collective land and establishing new land acquisition system, building social security system for land-loss farmers, fostering rural land market in order to ensure equal important status between collective and state-owned land ownership and seting up restrictive system to strength farmer's idea for protecting their own rights.
