Problem, Reasons And Countermeasures Of The Applying For Paroling

The paroling system is a useful kind of way to set free the repentant prisoners ahead of schedule attaching some terms. In our country, this system is an important punishment executing system. It exerts very important function in many ways, such as speeding the prisoners realize their faults, correcting their faults and taking a new beginning, regressing the society smoothly. But, it also exists many problems in legislation and practice. In my paper, I'll first proceed with the mess in the applying for paroling. Then, I'll analyze the reasons why there are so many problems in it. At last, I'll give my individual suggestions for how to perfect our paroling system.There are such as the dosage of applying for paroling is low; the applying range is narrow; the prisoners rights and interests can't get good protection during the submitting, inquisition and withdrawing procedures; the rules can't get useful protecting in our systems. It is bad for developing the prisons' work and the prisoners go back to the society. And it'll also bring many bad influence for prisons' work. For the reasons, because of the traditional judicial thoughts and the judicial system are dropping behind the needs of rule of law; the lack of the co-operation and good, scientific system and so on. In my opinion, our paroling system must get further consummating. At first, we must update the new paroling conception in our judicial thoughts, we must set the view of paroling rights, the view of justice procedure and the view of full-scale paroling. The second, we must afresh make sure the decision rights for paroling, making the reasonable confection to it. The third, we must redesign bur paroling system in criminal legislation, found a whole perfect paroling system. Thereby, our paroling system will accord with the needs of rule of law, and it will take greater active function in our prisons' work. It will also exert very important meanings in transforming the prisoners thoughts, turning the negative factors to active ones, realizing the aims of the punishments, accelerating the democracy and legal building and advancing the tenor by fathering our country in law.
