Economic analysis of law has been developing very fast since its booming in 1960s in the USA. The theory has achieved significantly in the research of contract law, property law etc. The theory uses the economics method to analyze the legal system in reason, and brings a brand new breeze to the Jurisprudence. The publication of Richard Posner's Economic Analysis of Law and An Economic Theory of The Criminal Law witnessed the formation of theory of economic analysis of criminal law. The scholars conducted novel and deep contemplations on the root of crime, classification of crime, decision of crime, nature of crime, optimal level of criminal sanction.Facing the current situation that we have lagged behind in economic analysis theory research, the author starts with the economic analysis of penalty.
