Research Of The Administrative License System Reform

The administrative examination and approval is a system with extreme importance in the process of the execution of administrative management by our government. It has played an irreplaceable role in reinforcing administrative management system, safeguarding public security and social system, and protecting the legal rights of citizens, corporations and other organization as an effective instrument of executing power and is given full attention and widely adopted in countries all over the world. However, with the deepening process of reform and the establishment of market economy, the shortcomings of the administrative license systems becomes more and more distinct. The market economic system is baffled by too many administrative licenses and the poor guarding systems to be perfect .The administrative examination and approval system reforming is not only a innovation of government's function, but also the request of global economy. This paper has analyzed our country's current problems and their causes that exist in administrative license system and discussed the necessity to reform in this system, it has illustrated the significance in the reform of administrative license system. This paper make the reform of administrative license system researching by the market economy theory, the public administration theory and the legal system. Giving some examples of the process and the fruits on administrative examination and approval reforming, analyzing the question during the reforming. From comparing to the measures that performed by the America, Japan etc, put forward measures and countermeasures to the reform. In the final part of this paper, namely build the administrative examination and approval system that qualified to the market economic,public administration and administrative legal system. Furthermore, the paper suggests to create an evaluation mechanism on this reforming, in order to offer a long and dynamic management to the reform. In the administrative system reform, only by making the criterion of administrative license and configuring the government administrative function, we can build the probity, effective government, and adapt administrative license to the socialism market economy system.
