A Study On Civil Liability Of Operators Of Transport Terminals

The thesis begins with the meaning of Operator of Transport Terminals, whose independent civil status is detailed discussed and analyzed on the basis of introducing and evaluating the international and domestic civil liability law of the Operator of Transport Terminals, and gives a suggestion to bring it into "Performing Party" of Transport Law; After studying the doctrine of liability fixation of Contract Law and transport laws and compared with the doctrine of liability fixation of the transport terminal operators, the author holds that the principle of presumption of fault should be applied; This paper also suggests that the period of liability of Operators of Transport Terminals should be in accordance with that of carrier on the foundation of analyzing the period of liability of related transport laws; At last, the article discusses the limitation of liability of Operators of Transport Terminals and the rights of noncontractual claim and correspond legislations suggestion is put forward.
