A Study On The Right Of Compensation For Damage To Goods Carried By Sea

At the core of the maritime law-carriage of goods by sea law, the right of compensation for the damage to goods carried by sea and the region of carriers' liability constitute the nucleus of rights and liabilities in carriage of goods by sea. Western countries dominate the ocean transportation nowadays, while their laws put a great influence on the worldwide maritime law. However, considering the generality of the law and the localization of the maritime law, the author tries to construct the general framework of the right of compensation for the damage to goods carried by sea on the basis of right to petition in the civil law.In respect of the logicality, this dissertation consists of following parts: characteristics, basic rights and the environment of the right of compensation for the damage to goods carried by sea. Those three parts combine themselves into a unity logically, only after the research of which a macroscopic level might be reached for the intended study from the perspective of right to petition.In respect of the technique used, the author applies both the induction and deduction. Specifically, the author summarizes the characteristics of right of compensation for the damage and guiding principles of the right of compensation for the damage to goods carried by sea, from which the characteristics of the right of compensation for the damage to goods carried by sea are then inferred and relevant issues on the right are solved.The centre point this dissertation makes is a relatively new perspective for the study of the subject right, which the author hopes can be applied to other...
