Several Issues On Study Of Giving Bribery Crime

Taking punishment for bribery crime is the linchpin upon fighting corruption, while Bribery is the source caused the crime of accepting bribes. The main reason why it is difficult for anti-corruption work to achieve remarkable results in China is the lack of research on the crime of bribery. Since China has signed the "United Nations Convention against Corruption", in relation to the same offense. There are some differences even conflicts between"United Nations Convention against Corruption"and China's "Criminal Law" to some extend. So this is a choice for us that whether we should take the international law as a standard or still insist that domestic law. When international law conflicts with domestic law China has the responsibility to assume the international obligations of the international community.After the signing and ratification of the"United Nations Convention against Corruption" the issues which is about the improving and coupling in China's criminal law on crimes of embezzlement and bribery in particular and the International Covenant are also placed on the docket. These issues aroused great interest to scholars. In recent years, we have focused on the research on bribery accepting crime both in the field of criminal law and judicial practice. The research into bribery crime is still very weak. So there are many problems which are not conducive to the fight against corruption both in theory and in practice.
