On Crime Of Transformed Robbery

Robbery is a kind of commonly-seen crime of property violation with greater harmful effects compared with other crime of property violation. Therefore, the revised criminal law intensifies the punishing degrees with regard to the crime of property violation and adds the aggravation penalty. In judicial practice, the crime of property violation transformed from theft, swindle and dispossession is a typical form of crime. Its typicalness lies in the transformation of the crime quality from larceny, swindling and plundering to robbery. The t crime of ransformed robbery belongs to violence crime with its complicity and serious effects, therefore, it is always the cracking down target in China's criminal law and also one of the difficulties in judicial practice. Article 269 in the current Crimial Law has made relevant provisions for the crime of transformed robbery, yet they are too principal to practice, thus bringing many difficulties in judicial practice. When judicially handling such cases, one should understand the original intents of the provisions in article 269, and grasps precisely the suitable conditions for the crime of transformed robbery, which is of significant importance in the practice.This paper makes a primary research on the crime of transformed robbery on the basis of relevant provisions in China's criminal law. It starts from the concept and characteristics of the crime of transformed robbery to analyze in detail the criterion for identifying such a crime; then it continues to explain the differences between ordinary robbery and the transformed one; and finally it expounds the identification criterions, punishment standards and the defects of and ways of perfection for the crime of transformed robbery in current legislation.
