Research On China's Civil Service System

By reviewing and analyzing the present situation of civil service system of a certain intermediate court in the central part of China, also the attempt of reforming the civil service system in some Chinese courts, some corresponding suggestions of reform and consummation of the civil service system in China are provided in this article.This article is composed of four chapters.The first chapter: summary of civil service. Firstly, the author introduces definition, characters and methods of civil service. Then, civil service is deemed to basic system of civil litigation by the author. Thirdly, the author analyzes the function of this system from different aspects. Finally, he indicates the value of civil service is pursuing the maximum of the procedural justice and litigation efficiency, based on separately set minimum of the procedural justice and litigation efficiency.The second chapter: present situation and problems in civil service system. In this chapter, the author chooses a court in central part of China as its object of research in order to reflect the common present situation of the civil service system. The author made a Stat. on the situation of decision made in a prolonged trial time and overtime period because of civil service, then another Stat. on implementation of six civil service methods is processed. By doing this, he has found large numbers of systematic and contrived problems, and reasons of those problems have been analyzed.The third chapter: the courts' attempt to reforming the civil service system and the analysis on it. The author analyzes the Suggestions on Application of the Civil Procedure Law of PRC, enacted by the Supreme Court, and some attempts of reforming the civil service system such as service by special staff and vehicle, service by the phone, service by the party, service by special mail of the courts , service by announcement of the decision in the court, and enlargement of substituted receivers of litigation documents . Finally, the author strongly suggests the service by special mail of the courts.The fourth chapter: reform and consummation of civil service. Focused on the reform and consummation of the six methods of the civil service system, the author provides some suggestions, such as setting up the direct service system in different places;, abolishing witness rule of retainment service system, setting up direct retainment service system in different places, regulating the application conditions of the service by publication; setting up a system to review the publication service system and so on. Meanwhile, the author suggests set up the digital service system, set up the system for the party to choose methods and providing address of civil service.
