| Strik- hard has devoloped three times in national scope,it lasted 20 years. In this 20 years, the theory and practice department have different opinions about it,either support,either opposite,or compromised. The author use the real proof method,examines the strik-hsrd policy carefully from the direction of punishment. Thourgh comparative analysis,author found,in overall,punishment is leally and depend on the law,it tend to slower ane lighter also. In the practice,punishment of strik-hard cases have problems,and some of them are seriors.for example,measurement's at will can't safeguards the accussed person's lawsuit right,as a result of principle's depart from,compared to Non-strik-hard,some cases in the strik-hard are not heavily and quickly,so it can not reflect the priniple and con notation of strik-hard,further more,it make strik-hard not tcike itself. and at last,endangered the value of it. In view of the existed question,author proposed own opinion about how to perfect the measurement of punishment and how to make the policy of strid-hard be able to carrying out correctly and let it usefull. At first, judical worker should presist that strik-hard policy is the direction of punishment. The second,expliot the function of spicial criminal law in order to avoiding measurment's at will. The third,trasp the prensent situation of punishment correctly. The forth,guarantee fairly and efficiency at the same time,make every effovt to measare punishment quickly.
