It is one of the basic systems that the criminal procedure law of our country establishes not to procedure the system criminally . This system is used very extensively in countries all over the world. In our country, this system have not used extensively abroad far because of many factors ,such as traditional law concept .criminal policy and the limitation in lawmaking. The text in terms of theory and practice, studied the theoretic origin and the value of this system, analyse the Changsha Prosecute Court, point out some questions in lawmaking and judicature practice, give some advice on these questions: enlarge the rang of absolute not prosecute; improve the redress measure; harmonize the conflict between public prosecute changed private prosecute and not prosecute system and found grand-prosecute system.Chapter one : mainly introduce the concept, essence, sort, the theoretics origin and value of the criminal not prosecute system.Chapter two: analyse the system in our county, mainly demonstrated analyse this system in Changsha prosecute court, and point the deficiency of the system relation to our country.Chapter three : gave some advice aiming at the deficiency and linking with the fact in our country to improve the system.
