Then a new phenomena appears, which is fraud in lawsuit. Though it has bad harm to our society, there are no definite provisions in Chinese criminal law. So it's a problem full of disputation. This paper consists of four parts.In Summary Of Fraud In Lawsuit, the conception, character and types of fraud in lawsuit are discussed. Besides this, criminal provisions overseas and in our country are introduced.In Theoretical Dispute On Qualitative Analysis Of Fraud In Lawsuit, it involves scholars'different opinions about qualitative analysis of fraud in lawsuit not only in Germany and Japan but also in China.
