This article is a detailed study on the functions of the condominium associations in comparative law. The purpose of this article is to provide reference and suggestions for the improvement of relevant legal system in China through studying on theories and practices of the functions of the condominium associations in other countries.The whole article consists of three parts: Preface, Main Part, and Ending. The Main Part is divided into three chapters.Chapter One carries on two important conceptions related to the topic, public possessions and management stipulation. The reason is that the functions of the condominium associations are to manage the public possessions and execute the management documents. And the management stipulation is always called the charter of the condominium associations.Chapter Two mainly expounds the functions of the condominium associations from three aspects, how to manage the public possessions, how to raise money and how to execute the rights of establishing rules.Chapter Three mainly analyses the duties of the condominium associations from company theory, tort theory and contract theory. It mainly discusses how the associations not to exceed their authority and obey the fiduciary duties from company theory.
