International Trade Finance Security Law Research

Trade finance is a short term credit approved by the bank to its customer under international trade .It includes import letter of credit, shipping guarantee, Bill of lading endorsed, trust receipt loan, packing loan, export negotiation, bill discounting under usance L/C, Forfaiting , International Factoring, export documentary collection, trade finance under export credit insurance and export invoice finance products etc..From the points of trade finance security methods , combined with different country banking and law theory and practice ,compared with foreign country's security system,the writer intended to state the law character of our country's trade finance security .It also discussed how to perfect our country's trade finance security law and operation ,how to reduce risk and then protect different parts rights.Since trade finance products are very ample and continually innovated, Its security methods are also very complicated. it can even combine several security methods when operating only one product. It is very different with RMB credit business. The writer systemly addressed trade finance security law character based on her working experience on international trade and credit business.Firstly, the writer discussed the security law problem from the respects of import and export trade finance products. The import security includes: import L/C deposits, documents of title under B/L, trust receipt .Export security includes: pledged by export shipping documents ,foreign bank or factors' payment guarantee and traditional third party assure, pledge or mortagage.Finally ,the writer compared our country trade finance security law with foreigners and discussed our country security innovation .Although there are still many problems with these new security innovation it is still very helpful to our business and trade finance will be accepted by the more customers and develop more rapidly.
