In this paper, with a discussion first on the origin, objective and work range of VTS, the author then proposes that the competent authority of VTS should be the state administrative department being responsible for the exercising of executive functions on behalf of the state government, based on analysis on the present status of management and function of VTS. Composed of both information consultation and compulsory execution, VTS authority may bear different responsibilities accordingly in this regard. This necessitates the operation of VTS, safeguarding the benefits of the ships and third parties, as well as corresponding to the basic principles of fairness and justice of the law. This also may solve the problem relating accidents resulted from faults of the VTS operator. The VTS operator shall bear no liability or unable to take such liability as matter of fact, which would lead to a outcome that the interest of the ship and third parties is overlooked. It's hoped that the state government take immediate measures and fill this gap, so that VTS in China can keep up with international requirements as result of batter management.
