Research On Certain Legal Problems Of Liability Exemptions Of Marine Cargo Insurer

On the basis of the pertinent theories in Maritime Law and Insurance Law, the article systematically approaches the liability exemptions of maritime cargo insurer from the angle of international private law, jurisprudence and comparative law through the classification and analysis on the liability exemptions regulated in Chinese law, English law and relevant policies.The article is divided into four parts. Chapter 1 is about the summaries of liability exemptions of maritime cargo insurer. Through the introductions with regard to the concept of liability exemptions, the classification and comparison of the items of liability exemptions, legal effect on liability exemptions and diverse factors restricting this legal effect, this chapter wholly shows the general situation about liability exemption of maritime cargo insurer. In the Chapter 2, main contents are the legal and agreed liability exemptions in Chinese law. This chapter analyzes the legal liability exemptions from both direct and indirect angles and examines the agreed liability exemptions under PICC policy. The Chapter 3 introduces the same issue in English law and ICC policy. In the last Chapter, the author summarizes the comparison of legal liability exemptions between Chinese law and English law, the differences of agreed liability exemptions under PICC policy and ICC policy, and proposes some solutions.
