The employment relationship is a legal concept, which has been widely used in the world. It will always be the main carrier, by which the workers can obtain their rights and benefits related to employment in the labor law and in the social security field. The employment relationship is also the key reference point, by which the nature and scope of the rights and the obligations of workers and employers can be determined .With the appearance of the Disguised Employment Relationships in the labor market, how to regulate the Disguised Employment Relationships has become a main task which the Modern Labor Law must face with, the law in China regulating employment relationships, still faces with a predicament of the lack of systematic, how to provide the necessary theoretical underpinning and the selection of mode in order to improve labor relationships legislation in China ,has become one of the more important theoretical issues ,on the basis of researching the basic theory of the employment relationships and analyzing legislative developments abroad This article has been written in logical analysis method and integrating theory with practice. In particular the fundamental theory and fundamental content of the Disguised Employment Relationships has mainly been studied in the article . The specific countermeasure has been clearly proposed in the end on the basis of questioning and then analyzing the question.This article consists of five parts and it's main content is as follows: The first part of the article is to introduce the background and significance of the research and the level of the study on question above of scholars in the world.The second part of the article is to introduce ILO and International Labor Standards and the latest legislative developments and to explain China's relates to ILO and the potential impact of 'Employment Relationship Recommendation of 2006' to China.The third part of the article is to examine the historical evolution of regulation of employment relationship as a starting point to Industrial Revolution and to demonstratethat the industrial relationship is the main adjusted object of Labor Law and to analyze the main subject and rights and obligations of the industrial employment relationship in the further.The fourth part of the article is specifically to analyze the meaning, the main type, the form, and the legal character of the Disguised Employment Relationships and to elaborate the social values and legal issues of the Disguised Employment Relationships The fifth part of the article is to elaborate the necessity of legislation of the Disguised Employment Relationships on the basis of analyzing the situation and the problem of China . A specific countermeasure to regulate the Disguised Employment Relationships and to improve the legislation of the Industrial Employment relationships is to be proposed in the end.
