Study On The One-man Company Regulation

With the economic development and the increasing individual need, there are growing numbers of countries that acknowledge the existence of one-man company. Our new established <> has clearly acknowledge the legitimate status of one-company. The new law has specified the one-man company and this is meaningful. But the one-man company is a new issue to us therefore; the law still need make some improvement. Base on the fundamental question of on-man company, this paper takes the foreign experience as reference and give suggestions on the demerits of current law being concluded.This paper is divided into four parts. The first part will introduce the concept, characteristics of one-man company and make a comparison of one-man company in different countries and with the private-owned company. the second part will introduce the process of one-man company law at home and abroad. The third part will introduce the legitimate status of one-man company; the establishment of denying of corporation personality system of one-man company law both at home and abroad. The fourth part concludes the legitimate regulation and meaning of one-man company in our country, based on which this paper will give some suggestion for the improvement of current one-man company system.
