| Environmental problem is the inevitable outcome during the human society historical development. There occurs the world-wide trend of criminalization of the behavior concerning environment pollution and damage to resources. Due to our country's great need for environment protection and the tendency for international social criminal legislation, the sixth chapter for the criminal law of 1997 that is destroy the society administration discipline define the crime for destroy environment resources, and article 408 the ninth chapter that is crimes of dereliction of duty define the crime for environment supervising and managing dereliction of duty, forming its own environment criminal law. Because the specialty for the subject and the object of the crime for environment supervising and managing dereliction of duty, it decides its difference with traditional criminal law. In the face of more and more serious environmental pollution, do the research and discussion on environment supervising and managing dereliction of duty crime, thus make it be perfected in legislating seem particularly important. On the former study fruit, by means of analysis, generality, comparison and so on, the paper do a perfectly research on the concept of the crime, historical evolution of the crime, the constitution of the crime and legislation perfection. The paper also gives rise to its own points and views on the nature of the crime, the objective aspects of the crime, the subject of the crime and the determination of the crime. The paper is constructed of four chapters. The first chapter is on the legislation evolution of the crime and the legislation commentary on foreign countries. The second chapter introduces the concept and the nature of the crime. The third chapter analyses the constitution of the crime. The fourth chapter is on the determination of the crime and the guilty weak point of the crime in legislation, and put up some proposals on how to perfect the legislation of the crime.
