On The System Of Carrier's Responsibility In The Passenger Transport By Urban Public Bus

By analyzing the actuality of passenger transport in the urban bus, the problem the system of carrier's responsibility in the passenger transport by urban bus was brought forward. This paper is composed of five pares: part one is the summarization of passenger transport in the urban bus, including the conception, property, content, characters of passenger transport in the urban bus; part two is about the system of carrier's responsibility in the passenger transport by urban Bus, consists of the conception, characters and period of responsibility; part three is discuss upon the law sources of the system of carrier's responsibility in the passenger transport by urban bus and the legislation of Hong Kong; part four is the core of this paper, including the the principle of attributing responsibilities, inscape and compensation of the system of carrier's responsibility in the passenger transport by urban bus; part five puts forward the proposal of consummating the carrier's responsibility in the passenger transport by urban bus from the managerialism of carrier, format articles and probing into the legislation. Finally, this paper comes to the conclusion that the principle of attributing responsibilities of carrier's breach of contract is strict responsibility principle on bring damages to passenger and fault responsibility principle on bring losses passenger, the principle of attributing responsibilities of carrier's tort and negligence in making the contract is fault responsibility principle. Carrier should compensate for passenger's losses according to this principle of attributing responsibilities. This paper pectinating the law, regulation about the system of carrier's responsibility in the passenger transport by urban bus, in order to consummating the system of carrier's responsibility and use for reference, guidance on judicial practice.
