In1954, the first Constitution of the People's Republic of China,Article 75 haddeclared clearly: Cases in the People's Court are trail in accordance with the law of implement the people's jury system.. Subsequently, the concept of people's jurors disappeared on the Constitution level. Until Aug 28 th 2004, the 10 th NPC standing Committee adopted a decision on improving the people' s jury system, then the people's jury system has again aroused people's attention. But the decision is to establish participate trail system not the jury system ,and this incompletely reform can not solve the chronic problems of the judicial and the resulting problems.Based on the concept of people's jurors, civil-law system and common law system major countries in the jury system and the present situation of our people' jury system. To the conclusion that in order to realize the principle of sovereignty of the people announced in the Constitution, ensure judicial justice, radical judicial corruption and deepen the reform of the judicial reform, the people's jury system reform is needed to create a genuine people'jury system.
