On Registration System Of Real Estate In China

With the enactment of Property Rights Law, to establish a perfect legal system of registration for real estate rights is urgent. These years, it has been researched by many scholars or experts in our country. Although my knowledge and the data are very limited, I am also willing to make my contribution for it. The paper includes four parts.The first part of the paper is about the basic theories of the legal system of registration for real estate rights .The author explains the concepts of real estate and registration for real estate rights, and elaborates the principle of publicity and confidence.In the second part of the paper , the author introduces three typical legislation of real estate registration in the world .They are France Registration Regulation ,Germany Registration Regulation and Torrens Registration Regulation .At the same time, the author analyses their respective characters from four perspectives . Finally, the authors put forward own views.The third part of the paper states our country's the legal system of registration for real estate rights, and the author point out five shortages of the present system.In the fourth part of the paper, the author put forward the proposals of the seven principal aspects, such as the principle of distinction examination, trust registration system, the Open inquiry system of real estate register and etc.From above, the author thinks there are many shortcomings in our country's present registration system .When we establish a comprehensive legal system of registration for real estate rights, we should follow the principle of publicity and confidence and also consider our country's specific conditions.
