On Perfection Of China's Tourism Law

Tourist industry has the laudatory title of "smokeless industry" and "eternal rising industry", it has important meaning for expanding employment and increasing tax revenue. The tourist industry of China has developed very fast in recent years, and it also obtained outstanding achievements. However, an inconsistent one is, we stagnate all the time in legal construction of tourism, this is unfavorable to the sustained development of tourist industry. So, there is a stronger academic and realistic meaning to study improving the existing Tourism Law system of our country.Firstly, this paper starting from the basic theory of Tourism Law in chapter one, and make a brief illustration of the characteristics of it, which are different from the other department laws. In chapter two, the author takes Japan, U.S.A, Mexico, three developed countries of tourist industry as an example on this basis, and research on some methods in tourism legislating of theirs, then compare with the current situation of ours, find the deficiency in China's Tourism Law. And the deficiency also brings about many problems in China's tourist industry. In chapter three, the author analyzes the main problems in protecting tourist's lawful rights and tourism resources, and summarizes several concrete aspects which concerned with the deficiency of China's Tourism Law. In chapter four, direct against the actual conditions of our country, use foreign advanced legislative experience for reference at the same time, the author explains how to set up rational legal system structure, so as to ensure the continuation of tourist industry develops.As a conclusion in finally, Our country should regard issuing Basic Law of Tourism as the tap, regard improving the Special Law of Tourism as the focal point, based on Local Tourism Laws and Regulations with local characteristics, the department laws related to tourism is in concert and harmony at the same time, only by this way, it is possible to form a complete Tourism Law, which suits development of China's tourist industry, in order to realize the further prosperity of the tourist industry of our country.
