Study On Education Guarantee Law Under Perspectives Of Social Security

The education guarantee system is an important part of social security. In the modern society, the basic rights to education to be guaranteed are the most fundamental educational right to citizens, which are the basic human rights and the right to development in the Constitution on one hand, and the responsibilities of the government and society on the other hand. The education guarantee system consists of education welfare and education aid. The education welfare is a kind of social welfare that the state and the society provide all citizens in certain stage with basic education products or education treatment in pre-school education, compulsory education, secondary education, higher education, vocational education, special education and so on. Education welfare has such characteristics as generality, adaptability to economic base and developmentality. Education aid refers to the support provided by the state and society for those citizens who are not able to obtain the basic education. Education aid is ready for those citizens who lose the right to education because of disaster, poverty, sickness, illegal deprivement and so on, including helping the poor to obtain education, education charity, student grant, student loan, family aid for education and so on. Education aid is the supplement to education welfare.Many problems arising from the existing education guarantee system in China are as follows: seriously inadequate education guarantee, imperfect rules, lack of systematicness, and low-level legalization. Therefore, we must make systematic plans and overall arrangement, and accomplish the legalization of education guarantee system diligently.
