The access to drugs of developing countries under TRIPS agreement is key to maintaining health rights,protecting and developing public health of developing countries.Lack of basic drugs,developing countries can not control the extense of crisis and the loss of lives within more and more public health crisis.High price of drugs is the biggest barrier on obtaining the basic drugs for the people of developing countries.More and more strict intellectuals-protecting system restricts the freedom of designing patent system according to its own conditions of developing countries.This increases the weight of difficulty of obtaining drugs.As one of the developing countries,China also faces the public health crisis and the lack of basic drugs.Through analyzing the concept of the access to drugs, the rule and the opinion of TRIPS agreement on the access to drugs,this article is to study the access of all kinds of drugs in developing countries especially China and provide the help of solving the more and more public health safety of our nation. The article consists of six parts.The introduction simply indicates the importance of drugs to the global public health crisis.The first part indicates the concept , the raise of the access to drugs and the importance to maintain and develop public health. The second part indicates the rule and the opinion of TRIPS agreement on the access to drugs.The third part indicates the characteristic of the access to drugs of developing countries and the solving thoughts.The fourth part indicates the condition on the access to drugs of our country and the solving method.The epilogue generalizes the whole article and forecasts the propect of access to the drugs of our country.
