On Theoretical Research And Building Of China's Community-based Correction System

Community-based corrections is a new type of correction in recent years. Correcting criminals in the community can not only punish the criminals to show the punishment of law but also re-socialize the criminals to keep up with the development of society. Community-based correction embodies the individualization, socialization and humanity of penalty. Community-based correction is also the implement of the idea of respecting and protecting human rights and confirming the policy of harmonious society in penalty realm. Correcting criminals by community resources has been recognized by law in many western countries. China has been executed such measure formally since 2003, however, the dispute about the legitimacy has been since then. Owing to the drawback of our country's relative law system, the practice of community correction in China is in difficulties. In order to solve these problems, by the method of conclusion and analysis, this article firstly analyses the concepts, nature and value of community-based correction in China, meanwhile, the paper also analyses how to perfect law system concerned in China. This article consists of 3 parts.Part 1 is the summary of community-based correction. This part analyzes the concept, history, nature and characters of community-based correction.Part 2 is the bases and value of community-based correction. This part discusses the bases and value of community-based correction to support our country's community-based correction development.Part 3 is how to perfect our country's community-based correction law system. This part point out some defects of our country's community-based correction law system and make some suggestions on perfecting our country's community-based correction.
