On The Problems Of Theory And Practice About Administrative Guidance In China

As an offspring of the rapid development of modern market economy and the tide of administration democratization, administrative guidance has been attached more importance and more practice after the World Warâ…¡, which brings into playing its special administrative management effect. It has increasingly become an important administrative management measure, administrative manner and significant function, and a vital research object of modern administrative law. In developed countries, administrative guidance has turned into crucial administrative management means ,which contributes to each country's economic development. In our country, administrative guidance has played more and more important role in government macroeconomic regulation control and social management. At the same time ,the limitation and negative effects are gradually showed in administrative management ,which cause attention and dispute in the academic .My thesis discusses the theory and practice of administrative guidance, and then gives the advice about how to perfect it. There are seven parts in the whole article. The first part is about introduction: This part summarizes the administrative guidance the important status ,the positive role and the limitation which has in the modern administration which displays in the world main developed market-oriented economy country, and points out: In many countries around the world, the administrative guidance is a result of evolution of understandings and policies towards the state conception ,market function, government role and administrative model during development of market-oriented economy, especially after the Second World War. At last, it outlines the present situation of administrative guidance in our country, thus draws out the research mentality of this article.The second part is about the outline of administrative guidance: This part obtains from the administrative guidance concept and analyzes the administrative guidance's nature, the applicable scope and the classification. This part is for the purpose of stating some basic questions of administrative guidance. It limits the basic understanding of administrative guidance in this article and conducts the research of it.The third part is about the present situation of administrative guidance in our country . This part firstly analyzes the achievement in our country , and then analyzes the problems of administrative guidance from the practice and the system aspects, and then points out the necessity of consummating the administrative guidance in our country.The fourth part is about the comparative analysis of administrative guidance in other countries and in Taiwan. This part analyzes the legislation and practice in Japan ,America, Germany, Korea and in Taiwan, in order to give the absorption model for China.The fifth part is about the basic principle of the administrative guidance. This part analyzes the scholars'opinions about administrative guidance present in China and proposes the basic principles in our country. At last, it states the contents of the basic principles. The sixth part is about how to perfect and consummate the administrative guidance in our country .This part studies how to perfect the administrative guidance from the transformation of ideas, the legislation control and perfecting the responsibility and relief system.The seventh part is about the conclusion. It summerizes the whole article and restate the siginificant meaning of this thesis.
