Land extremely precious natural resources, the key factor of productivity , the important material for human's life and product and the crucial essence for promoting the construction of socialism new willing in our country .In order to promote the process of agricultural modernization in our country , develop village economy, improve the farmer's income , we should make the use of the land more effective under the condition of marker economy and the basic strategy of our country that we must cherish and make use of the land appropriately ,besides introducing science knowledge, carrying out education to help farmers, enhancing the construction of countryside infrastructure and people in our country and the resources for each person are so limited ,that is the basic condition in this country ,moreover, land belongs to all people in China on principle, and it is the basis of farmer's living. All they restrict the reformation of farm–oriented . Therefore, this paper focuses on the four waste-land which suffers less restriction and limitation. Collective four waste-land usually lies in a remote area , and itself contains a few mineral, all these including such physical characteristic take matter steam and energy steam make the exploitation of four-waste land very difficult. However, the room in which we could exploit four-waste land , it is valuable to do this in some degree. Compared with four-waste land ,four-waste land lays emphasis on the value of ecology among the value of economy ,ecology and society .In the meantime , its circulation suffers less limitation ,introduces the market mechanism to some degree, and those could arouse the enthusiasm of main body in the market to harness and the four-waste land .All these demonstrate the necessary to exploit and harness the four-waste land.In recent year, the biggest problem for the development of Chinese countryside economy is the money , and the finance appropriation could not meet the needs of its development far .Then how to collect enough money to harness and exploit the land and guarantee farmers'wish to run the land? This paper discuss the role which the mortgage system plays in such a course .Mortgage is the king of assurance, it doesn't transfer the ownership for the objects that one has right to deal with , that character protects farmers who lack money and couldn't win in the auction ,and makes them own the land and use their experiences and tricks to exploit and harness it.In practice ,Party and government importance to this issue, since Third Plenary Session of the 11th Central Committee of the Chinese Communist Party , there has been great success in harnessing the four-waste land by various means of exploiting and harnessing .So there are so many examples for us learn, such as Lv Liang in shan xi , jujabe farmstead in Shan Dong, Yan'an in san xi .This paper discusses the characteristic of four-waste land , the achievement and problems in the process in harnessing it . The use of four-waste land is supported by law and policy , but the main body of ownership of collection lands is unclear in the theory, departments in the organization of collection economy fight for rights. All these reasons make the number of the real examples of the mortgage of the collection land use so small. This kind of lack of law condition limited the function mortgage system for promoting the development of countryside economy seriously. Therefore , combining the condition in our country and the practice in countryside ,This paper explores the main body of the ownership of collection lands, the functions of collection farmers possessing and realizing rights, in terms of the former study .Passing through the puzzle aroused by the fact that the theory exists couldn't solve the mortgage system beam the perspective of economy, environment and law , economy and the farmers'requirement for four-waste land. On this basis, we recounts some contents such as the main body ,object, content , assumption and elimination, protection. Among them ,we attaches importance to the system of land register and estimation , in order to compare the four-waste land use mortgage system from the detail of procedure. What is valuable to add is that our system is socialistic public ownership , we couldn't change the fact that production material belongs to country and all citizens on principle ,so the transfer of lands are limited in use not the ownership ,is The mortgage in this paper only refers to the use .Though the systems abroad is perfect , become of the property , hen in this paper we only confine ourselves to the case of scholars in China.
