The Study On The Goal Of Legislation Of Current Environmental Law Of Our Country

The goal of legislation of environmental law, is the attain of purpose or realization of result the nation hopes when it establishes or approves environment law. Its decides the instructive thought, the object adjusted and the effect of the whole environment law, also in the meantime reflects the degree of environment law's development and attitude of mankind for nature. The goal of legislation of current environmental law in our country has been established according to the traditional" doctrine of human interest center ". This kind of goal of legislation is not fit for the trend of the current environment law of the world, and also has caused severe environment problem in practice, so it has to be adjusted quickly.This text first definites the respective content of the goal of legislation of environmental law and the environment ethics, analyses the relation between them, then we summarize the history of the development process of the goal of legislation of environmental law, analyse the goal of legislation of environmental law of some other typical countries,and refine the basic developing trend of environment protection legislation of the world. After the analysis of the goal of legislation of current environmental law of our country, discussing from the issue between " doctrine of ecosystem interest center " and " doctrine of human interest center ", we investigate the inevitability of sustainable development becoming the ethics basis of the goal of legislation of environmental law of our country.Finally,under the instruction of sustainable development, we establish a new goal of legislation of environmental law of our country, and then according to this new goal, we put forward a macro conceive for the improvement of environmental legal system of our country from five sides including law system, basic principle, basic system, management system and law responsibility.
